EXCLUSIVE Buyer Brokerage Agreement

In case you're buying a home in Georgia, you should be aware that there are limits on the responsibility of the real estate agents. Sometimes, a buyer may incorrectly assume that the agent is "working for them" and is working in the buyers "best interest". This is ONLY the case if you have signed an "EXCLUSIVE Buyer Brokerage Agreement" form. If you did not sign this form you are all on your own and anything you say or do can be used against you by the agent to benefit themselves or their seller.

EXCLUSIVE Right to Sell

Sellers almost always sign an "EXCLUSIVE Right to Sell" Agreement when they list a house with a real estate brokerage. The broker at that point is working for the seller and has a contractual duty to protect them. Buyers in Georgia are not required by law to have a representation agreement with a real estate brokerage. If you are a buyer without this protection, you may not be provided with critical information that may assist in your decision as you make a huge financial commitment.
